Terms and Conditions
The purchaser acknowledges that the goods herby sold and delivered or the services rendered by PENFOLD MOTORS GIPPSLAND PTY LTD are subject to the conditions hereinafter contained and that the purchaser has read them and agrees to be bound by them.
1: TITLE
Property in any article sold by the Company shall not pass from the Company to the Purchaser until the Purchaser has paid for the article in full and all cheques and other negotiable instruments have been cleared. The risk of loss or damaged to the article shall be entirely at the risk of the Purchaser upon delivery to the Purchaser. If any payment for the article sold by the Company is overdue or if the Purchaser pays the Company by Cheque (in full or in part) and such cheque is not met on presentation by the Company, the Company reserves the right to retake physical possession of the goods in full or partial satisfaction of the debt and for this purpose the Purchaser hereby consents to the Company or its agents or servants entering upon the purchaser's premises.
2: RETURNS
Goods returned for credit will be subject to a 10% handling charge. Goods approved for credit must be in the original, undamaged & unmarked packaging (no Texta markings) Invoice number must be supplied before a credit will be considered. Goods made to order will not be credited. Goods received in good condition and in original packaging quoting invoice number and date of sale. Freight to be pre-paid to suppliers warehouse.
3: CHARGE TERMS
Trading terms are Nett 30 days. Failure to adhere to these terms the account will become COD until such time as the account is paid in full. The Company reserves the right to determine when the account will be reopened. Non-payment of this debit by the due date will be considered by the company to be a breach of the terms of sale and, in addition to any other rights this Company may have, interest will be charged on any outstanding amount at rate of 18 percent per annum.
4: PRICE
The prices set out or referred to herein are recommended prices only and there is no obligation to comply with the recommendation. The prices are ex-warehouse, packing extra and are subject to change without notice.
5: CLAIMS
No claims for shortage or damaged items will be recognised unless notified immediately on receipt of goods.
6: FITMENT OF PART
No responsibility whatsoever is accepted by Penfold Motors for the fitment of incorrect parts. The onus is clearly with the fitter to ensure the parts supplied are correct for the particular job. Any damaged to parts or consequential damaged or cost resulting from the fitment or painting of the correct parts are totally the responsibility of the fitter, and are non returnable.
7:WARRANTY
All warranty claims are subject to our supplies conditions. Non genuine parts are identified by the prefix NG. These parts are not covered by vehicle manufacturer’s parts and accessory warranties and may affect the warranty provided by the vehicle manufacturer for your vehicle.

Carefully check these goods against your order. The purchaser is responsible for all goods supplied on order or by any person /agent in their employ.

Monies owed by the Purchaser to the Company shall become due immediately upon the commencement of any act or proceeding in which the purchaser's solvency is involved.
WHERE INVOICES ARE CLEARLY STAMPED ("SPECIAL ORDER THESE PARTS ARE NON-RETURNABLE" ) NO CREDIT WILL BE ALLOWED.
No credit on goods after 14 days from original invoice date. No credit on goods under $10.00.
No credit on goods purchased from interstate or specially procured.
No credit on electrical items.
CASH SALE. No refund will be given without this receipt being produced.
